1. Aggregation of personal data in FIGU files

All personal data provided by the User through the page www.figu.pt, hereinafter the “site”, will be aggregated for the following purposes: to enable the provision of services requested by the User, such as keeping him informed through electronic means, about the site's products and services.

It is necessary to fill in all the data requested through the website in order to obtain an optimal provision of the services made available to the User.

2. Data communications made by the User himself

By publishing a comment or opinion on the website, the User tacitly and actively allows third parties to access such personal data, therefore Figu.pt and its owner are not responsible for the possible consequences or damages that the User, or a third person , may suffer as a result of their free decision to share them.

These General Conditions of Use and Commitment, onwards, the General Conditions determine, together with the privacy policy, access and use, by the user, of the website www.figu.pt and its sub-domains (hereinafter “the Site”), as well as the products and services contracted through it.

By accepting these General Conditions, the User determines that: he has read, understands and understands what is set out in this document, that he has the capacity to exercise his rights and to be bound and that, therefore, he assumes all the obligations set forth herein.

The use of the Site attributes the condition of User of the same (hereinafter “the User”) and implies the acceptance of all the terms included in these General Conditions.

Access to the Site is free, except for connection costs through the telecommunications network, provided by the provider contracted by the User.

2.3. Rules for using the Site

The User is obliged to use the Website, all its content and services, in accordance with the provisions of the law, morals and public order and these General Conditions. You are also obliged to properly use the services and/or contents of the Site, without their application in carrying out illegal activities or constituting a crime that violate the rights of third parties and/or that infringe the regulation on intellectual and industrial property. , or any other applicable legal regulations.

2.4. Disclaimer

Figu is not responsible for damage caused to the software and computer equipment of Users, as well as third parties, during the use of the services offered on the Site, or finally, for damages resulting even from the suspension or closure of the Site during provision, or for network damage.

2.6. Intellectual and industrial property

The contents of the Site, such as texts, photographs, graphics, images, are the intellectual property of the owner of Figu.pt or of third parties and cannot be understood as transferring to the User any of the exploitation rights recognized by the current law in terms of intellectual property. .

The brands, trade names and logos are the property of Figu or third parties, and access to the Site cannot be understood as a right attributed to them.

By accepting these General Conditions, the User assigns to Figu.pt, free of charge and exclusively, all exploitation rights over the articles, comments and opinions (hereinafter “the Contents”) published by the User, or whose publication he authorizes. in the website.

The User, who claims to have all the intellectual property rights over the aforementioned articles, comments and opinions, is obliged to assume any claim or responsibility, including compensation for damages and losses, that a third party may execute against Figu.pt and its holder, considering that its rights are infringed by any action arising from the obligations that the User contracts, directly or indirectly, with these General Conditions.

Likewise, the User is obliged to keep Figu and its holder unharmed in the face of any damage that he or a third party may suffer as a result of the formalization of the attribution of rights regulated in this clause.

3. Commitment Conditions

3.1. Product images and availability

We ask that if you find any type of error, you communicate it so that we can proceed as quickly as possible to correct it, for the benefit of all Users. Likewise, if you purchase any product on this page, we advise you to confirm that the name of the product is the one you want.
All product orders will be subject to their availability.

3.2. purchase procedure

The procedure for purchasing products through the Website's Online Store is as follows:

• The user adds products to the cart;
• The user confirms that he wants to purchase them on the Store page;
• The user identifies himself and the sending/receiving address;
• The user chooses the payment method;
• The user pays through that method;
• The website and its management validate later and within a maximum period of 48 hours the confirmation of this payment and its receipt.
• The products are sent to the address designated by the user.

3.4. Delivery of orders and returns

The products purchased by the User will be sent via CTT. Shipping costs are borne by the website itself and its owner for purchases over €100 and for deliveries in Portugal.

Delivery of orders will be carried out at the shipping address, freely designated by the User in the order form. Figu.pt and its holder will not assume any type of responsibility that is not attributable to them, namely when the delivery of the product is not carried out as a result of inaccuracy or falsity of the data provided by the User, as well as, in the assumption that the delivery cannot be carried out for reasons beyond the control of the designated CTT, such as the absence of the recipient.

If the order is lost by the carrier, a claim must be made to the carrier and the customer will only be reimbursed for the amount paid or a new shipment will be made after the carrier responds to the whereabouts of the order.

Exchanges are allowed within 14 days from the date of receipt. However, the sold product cannot show any sign of use and must be returned as shipped, in its original packaging.

The item for exchange must be sent and identified to:

Exchanges will be processed within a period of 5-10 working days after receiving the item, except for personalized items that add 10 working days to the normal period.

In the event of a defect, Figu.pt undertakes to replace the defective product with an identical one, whenever it is available in stock. In the event that it cannot be replaced, its value will be refunded or the User will be given the option of choosing another product with the same characteristics.

In case of exchange of article, the customer will have to pay the reshipment costs of the new article.

For hygiene reasons, earrings cannot be exchanged or returned.

We do not accept returns of personalized parts or custom-made items, unless they have a defect attributable to Figu.

3.5 Delays in the delivery of orders

Orders are shipped via CTT. Figu is not responsible if orders take longer than expected. If there is any delay, the customer must wait a few more days and file a complaint with the CTT counter, as the order may still be delivered (albeit late). 

If the order is lost in registered mail, a claim must be made to the carrier and the customer will only be reimbursed for the amount paid or a new shipment will be made after the carrier responds to the whereabouts of the order.

3.6 International Deliveries

Shipments made to Europe and the rest of the world have a shipping period of between 5-15 business days, with delivery subject to the recipient's postal and transport services.

4. Cancellation and inefficiency of clauses

If any of the clauses included in these General Conditions were declared, in whole or in part, null or ineffective, such annulment or inefficiency will only affect said provision or the part thereof that is null or ineffective, these General Conditions remaining over the entire remainder and considering such provision, in whole or in part, as not included.

5. Item values

Figu has the right to change the value of items without prior notice. If any item is ordered on the site for a value below the reference value, due to the company's own lapse, Figu has the right to cancel the customer's order, leaving it up to the customer to accept the new price of the item. All items are subject to the current VAT rate.

6. Product warranty

Products purchased on the site have a 3-month warranty. If the product has any manufacturing defect or anomaly, it will be exchanged for another equal one or, if there is no Stock, it may be exchanged for another one of equal value. The stainless steel and silver parts require special care, so if there is negligence in handling the parts, the guarantee does not cover the exchange of the item. Each situation will be analyzed by our technical team.

7. Coupons and offers

Discount coupons cannot be accumulated in one purchase, unless it is indicated in the offer that they are.

   8. Applicable legislation

These General Conditions will be governed and interpreted in accordance with the legislation in force within the Portuguese State.
